Terms of Hire, Liability Waiver & Medical Disclaimer

Welcome to FreezeDrop. By completing a rental booking, checking out on our platform, or taking physical delivery of our 4-in-1 fat freezing and cryolipolysis equipment, you (the "Renter") explicitly agree to be legally bound by the following terms, conditions, and risk acknowledgments.

1. Absolute Ownership & Nature of Agreement

• No Sale: This contract is strictly a temporary commercial hire agreement. FreezeDrop remains the sole and exclusive owner of all rented goods, machinery, cables, accessories, and protective transport casing.

• No Sub-Letting: The Renter may not sell, lease, lend, assign, or sub-hire the equipment to any third party. The system must remain at the designated Auckland delivery address throughout the entire duration of the rental period.

2. Mandatory Medical Screening & Contraindications

Cryolipolysis (fat freezing) is a safe, non-surgical body contouring treatment, but it is strictly prohibited for individuals with certain medical profiles. By accepting delivery, the Renter warrants and confirms that they do not possess any of the following conditions:

Cryoglobulinaemia	Pregnancy, IVF treatments, or early postpartum
Cold Agglutinin Disease	Active hernias in or near the targeted treatment area
Paroxysmal Cold Haemoglobinuria	Open wounds, eczema, or active skin infections
Raynaud’s Disease	Severe diabetic neuropathy or circulatory conditions

3. Renter’s Operational Obligations & Care of Equipment

The Renter assumes full operational responsibility for the device from the exact moment of doorstep sign-off until our Auckland dispatch team collects it. You explicitly agree to:

• Follow Instructions: Read and follow all supplied step-by-step operating guidelines, cooling membrane placement instructions, and safety parameters carefully.

• Safe Storage: Store the machinery in a clean, dry, secure indoor environment out of reach of children or pets.

• No Modifications: Never attempt to open the device shell, alter the internal software wiring, or use non-approved third-party cooling anti-freeze pads or membranes.

4. Equipment Damage, Loss, and Late Fees

• Damage and Loss: If the machine is returned broken, physically damaged due to misuse, drops, or neglect, or if it is stolen while in your custody, the Renter is legally liable for the full commercial cost of technical repairs or complete device replacement.

• Excessive Cleaning: The machine must be wiped clean of all excess conductive gel or membrane fluids before pickup. Devices returned with excessive residue may be subject to an Excessive Cleaning Fee.

• Late Fees: If our team arrives for a pre-scheduled pickup window and you are not present, or if the device cannot be retrieved, a failed-collection fee and standard daily pro-rata rental fees will continue to accumulate until the system is successfully recovered.

5. New Zealand Consumer Law & Limitation of Liability

Accident Compensation Corporation (ACC Notice)

In accordance with New Zealand's Accident Compensation Act 2001, personal injuries resulting from an accident are managed exclusively through the national ACC scheme. This framework bars civil claims for compensatory damages regarding accidental personal injuries sustained within New Zealand.

Consumer Guarantees Act (CGA) & Fair Trading Act (FTA)

Nothing in these terms is intended to unlawfully exclude, restrict, or modify any non-excludable statutory guarantees or consumer rights provided under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

Maximum Liability Cap

To the maximum extent permitted by New Zealand law, FreezeDrop’s total aggregate liability arising out of or in connection with this rental agreement—whether in contract, tort (including negligence), equity, or statutory duty—shall be strictly limited to a total sum equivalent to the total rental hire fee actually paid by the Renter for that specific booking duration.

6. Governing Law

This agreement, its terms, and any legal conflicts arising from machine usage are governed strictly by the laws of New Zealand. Both FreezeDrop and the Renter submit to the exclusive jurisdiction of the New Zealand courts and the Disputes Tribunal.
